Intellectual Property

It's possible. In claiming "fair use" for your reuse of copyrighted material you need to keep several things in mind. Such as the purpose as well as the quantity of works included under the 'fair use' doctrine. Usually it is not an issue, but it is a question that can best be answered by the copyright holder or an intellectual property attorney.

For more information about the Creative Commons licesnce please visit them at http://creativecommons.org/

According to the license, anyone is allowed to freely adapt your work. "However, if you determine that someone has created a derived copy that is incorrect, or contradictory with your own, or worse, is defamatory or otherwise offensive, the license gives you the legal right to ask that person to remove your name from the module -- but not to demand that he or she change it as you wish."

The Creative Commons Attribution license explicitly allows another person to make a Derived Copy of any archive you upload to the site. A Derived Copy is a copy of an archive that has been modified and uploaded as a new archive under the new author's name. Your original archive is not changed and you retain the ability to delete it if you so require.

Definitively yes. The Creative Commons license is entirely "non-exclusive" meaning that you retain the right to distribute your material under a different license elsewhere.

Before you can upload an archive, you will need to sign up for an account on share.getwinc.com. As part of the sign-up process you must agree to the Creative Content Attribution license that applies to all the content found on this site.

All archives found on share.getwinc.com are copyrighted and the author of each individual archive retains the copyright of his or her material. Archives, by explicit agreement with creators on share.getwinc.com are licensed under the Attribution-Noncommercial-Share Alike license. This license allows the author to give others the freedom to copy, distribute, and display the work, and to make derivative works, as long as they give the original author credit. "Creative Commons is a non-profit corporation that promotes the creative licensing and re-using of intellectual works." From their Web site: “Creative Commons is a new system, built within current copyright law, that allows you to share your creations with others and use music, movies, images, and text online that’s been marked with a Creative Commons license.”

There are many reasons the Creative Commons license was a good choice. It has a history of proven use, and allows others to build upon your work, in essence contributing to an intellectual commons. As the Winc community grows it's hoped that the power of collaboration will lead to a greater community of lifelong learners who share and collaborate. The Creative Commons license used by share.getwinc.com will help the community while allowing you to ultimately retain control of your copyright. We also want to ensure that modifications to a work can not be sold for a profit at the expense of others.

This Winc community site is intended to provide and maintain a common location where all Winc users worldwide can create, freely share, and develop upon each others learning resources. To that end, we require that you and every other Winc archive creator who wishes to share on this site agree to be bound by a common license. This ensures that all parties are on even footing, and that the Winc community can equally share in all resources. All the archives found on this site are meant to be accessible to anyone without restriction and any creator can use that content, share it with others, or create a derivative work that is customized and personalized as per their needs. Without determining ahead of time what license to use, its assumed that the archives you upload are copyrighted by you regardless of it you intended to share it, or wanted it to be public domain.
